The Wikimedia Foundation, which operates the popular online encyclopedia Wikipedia, has formally challenged a recent Delhi High Court order that directed it to delete content deemed defamatory toward Indian news agency ANI. According to sources with direct knowledge of the matter, Wikimedia has appealed for a review by a larger bench of judges.

Court Case Originated from ANI’s Complaint

The dispute began last year when ANI sued Wikimedia in an Indian court, objecting to a Wikipedia entry that labeled the news agency as a "government propaganda tool." ANI requested the removal of such content, calling it misleading and damaging to its reputation.

In response, the Delhi High Court ruled in ANI’s favor last week, prompting Wikimedia to contest the verdict.

Wikimedia's Legal Position

Wikimedia has not issued an official statement but has filed an appeal with a larger panel within the same court. The foundation argues that Wikipedia functions as a user-edited platform and should not be held responsible for editorial content created by third parties.

The organization’s legal team is expected to defend its position based on international norms protecting online platforms that rely on user-generated content.

Background and Industry Context

ANI is partially owned by Reuters, which holds a 26% stake, but Reuters has publicly distanced itself from ANI’s operations and editorial decisions.

Wikimedia becomes the second major global platform, after X (formerly Twitter), to face legal challenges in India over content takedown orders.

X is currently engaged in its own legal battle concerning Indian government directives to block posts related to the 2021 farmers' protests.
