Former President Donald Trump once again mentioned that a third non-consecutive term in office as president may be within reach even with the two term limit set by the 22nd amendment of the US constitution. He made clear over the weekend that he is ‘not joking’ when he said he believed there could be ways to extend his presidency.
Trump was asked during an exclusive interview on NBC about comments he made in the past suggesting that he would be open to serving a third 4 year term. He was clear during the interview, stating “I’m not joking”, when asked whether he would really run for president a third time. He went on to add that “There are methods which you could do it”.
After serving as president of the United States, it is clear for anyone who chooses to observe that he means to draw an ‘after 8 years’ mark to the traditional limit of serving as president. It has now become evident, not only to observers but himself as well, that there is a plan in action which is more detailed to these comments as noted when he spoke on Air Force One. ‘Despite needing more than 4 years, there seems to be pressure or perhaps a support system from people that are saying you have to run again,’ he stated. When referring to his supporters the former president noted that ‘They love the job we’re doing.’
When asked whether he would remain in office after Inauguration Day on January 20, 2029, Trump dodged answering directly by saying, “I’m not looking at that, but I’ll tell you, I have had more people ask me to have a third term.”
Despite being constitutionally barred from running again, Trump boldly claimed he was given solid options that could make it feasible for him to pursue the presidential office again.
During an interview with NBC, Trump was asked what he thought of the possibility of Vice President JD Vance running for president and then immediately resigning after ascending to the office. Trump answered, “That’s one” method, before further adding, “There are others, though,” without providing additional context.
Obstruction to a third term
Speaking to the Associated Press, Professor Derek Muller, an expert on election law and a faculty of Notre Dame, pointed to the constitional obstacles that Trump faces concerning a third term. He was particularly concerned about the 12th Amendment, ratified in 1804, which prohibits electing a Vice President from the same region as the President. Muller further explained that if Trump is barred from running for president by the 22nd amendment, that also means he would not be able to serve as Vice President.
The adoption of the 22nd Amendment, which occurred in the year 1951 after the Roosevelt presidency which straddled over four presidential terms, It clearly states that a citizen can vote in only two presidential elections. Muller, who offered a detailed commentary for the Associated Press, was quick to offer the insight that “one weird trick” does not exist in the realm of presidential term limits. He also explained the inner workings of Trump's possible reelection, explaining that accomplish such a move would require extreme coordination with state voters, the officials from federal government pattern, courts and all other citizens.
Muller explained that “talking about a third term and actually taking one are two very different tasks” in connection with Trump and the counterclaims noting that it is politically expedient to portray power and strength if possible.
"A lame duck president like Donald Trump has every incentive in the world to make his presidency seem more active than it really is," Muller claimed.
He was also queried if at the age of eighty-two, which Trump would reach upon completion of his term, living the life of serving in “the most difficult occupation in the country’” is something that he looked forward to.
Fixing the constitution
Removing the two term cap off the Constitution would mean altering it and changing the document itself. Achieving this would be nothing short of monumental since it would take a significantly large4855225208numeric prime number1% in both Congress and the States in order to make any suggestion to the constitution. Then, from the rest of the states, three-quarters would need to support passing the proposed amendments.
The Precedent and the 22nd Amendment
Presidents in the United States have not actively pursued a third presidential term after the 22nd Amendment received ratification.
The United States has had a tradition that a president can serve for two terms and the country follows this norm since the year 1796. This was the year George Washington voluntarily retired after serving as president for two terms. And for the next 140 years, this remained a common practice.
This norm was disrupted by Franklin D. Roosevelt, who was elected four times from 1932 to 1944. He rationalized his prolonged presidency by saying it was necessary to have strong leadership during World War 2. After Roosevelt died in office in 1945, the United States passed the 22nd Amendment in 1951.
