Is it legal or illegal to drink alcohol in a parked car?

If your car is parked and you don’t have to drive it anywhere, can you spill the jam while sitting inside it? The answer to this is both yes and no.

Whether there will be action on alcohol and water inside a parked car or not, depends on where your car is parked. That means, if the car is within the boundary of your private property like a garage or house, then you can drink bad while sitting in it.

But if the car is parked on any public property like the roadside, bus stand, railway station, or any other place, then drinking alcohol in it becomes illegal. As far as the fine in such a situation is concerned, it may vary according to the states, but in the first instance, a fine of Rs 5000 to 1000 can be imposed.

How much penalty for driving after drinking alcohol?

According to Section 185 of the Motor Vehicle Act 1988, driving under the influence of alcohol or drugs is illegal. If more than 30MG of alcohol is found in 100ML of blood, or the presence of drugs is found in the driver’s blood sample, then that person can be punished under Indian law.

He may also have to pay a fine. If caught for the first time, the person can be jailed for up to 6 months along with a fine of up to Rs 10,000. If caught a second time, a challan of up to Rs 15,000 and a jail term of up to 2 years can be imposed. If caught after this, the driving license can be canceled.

How much alcohol can you carry in your car?

The answer to this question also depends on which state you are in. For example, in states where liquor is banned, if you are carrying liquor from another state, then action is certain to be taken against you.

In such a situation, a minimum fine of Rs 5000 and imprisonment for up to 5 years can be imposed. At the same time, in states where alcohol is not banned. There, one can carry 1 to 2 liters of liquor.

There is no condition of the bottle being open or closed. Just keep in mind that you should not drink and drive. If you carry more liquor than this then there is a provision of fine and punishment up to Rs 5000.
