
The Supreme Court on Tuesday overturned a segment of the Calcutta High Court's ruling that directed a CBI investigation into the West Bengal cabinet’s decision to create supernumerary posts in state-run and aided schools.
A bench led by Chief Justice Sanjiv Khanna and Justice Sanjay Kumar stated that such cabinet decisions fall under the constitutional domain and cannot be scrutinized by a court of law.
Teacher Appointment Probe to Continue
However, the apex court clarified that the investigation into the appointment of 25,753 teachers and staff in West Bengal’s schools will continue. These appointments were previously declared invalid on April 3 by the same bench, which found the selection process “vitiated and tainted.”
Meaning of Supernumerary Posts
A supernumerary post is a temporary role created to accommodate an employee eligible for a permanent position that is currently unavailable. The High Court had earlier ordered a CBI probe into the state cabinet’s decision to create such posts as part of the teacher recruitment process.
Court’s Clarification on the Ruling
Chief Justice Khanna noted that the court’s observations apply only to the CBI directive on supernumerary posts. “Our observations in this order are limited to the extent of direction to investigate the creation of supernumerary posts and not in any way reflect upon the investigation and chargesheets filed by CBI in other aspects,” he stated.
