The presiding woman judge in Delhi was subjected to both mental violence and threats from a convict alongside his lawyer in a six-year-old cheque bounce case, leading to fury concerning the treatment of judicial officers and their wellbeing within courts.

The alleged misconduct happened on the 2nd of April, during “Shivangi Mangla’s” courtroom session of Judicial Magistrate First Class, when she executed a conviction pronouncement – aligning with Section 138 of the Negotiable Instruments Act.

Threatening Humor Combined with Physical Violence

Based on a report by Indian Express, it came to light that the convict had directed curse laden expressions and threats towards the judge, in the following words: “Tu hai kya cheez… bahar mil, dekhte hai kaise zinda ghar jaati hai.”

(Translation: Who are you even? Meet us outside, and we will see how you return home alive.)

Along with these statements, Judge Mangala noted in her enforcement order that the convict made a genuine attempt to hurl some object towards the Judge and ‘mouthed’ words such as “mother daughter” in the lowest possible way of civility one can afford.

Comprehensive Mental and Physical Abuse

Besides those, the judge maintains that both the defendant as well as his counsel Athul Kumar, intimidated her with false complaints and compelled stern allegations of them to face her with resignation demanding perjury unless they were released. The matter was delineated as mental and physical violence of her, and she has sought proper legal measures.

Actions of a Legal Nature:

The judge per the order NCW should take action against the individual in question.

An explanation notice was served to counsel Athul Kumar of the court for that he must answer in writing for his actions in court.

The judge on April 5, 2023, following the decision, held that the said prisoner will serve twenty-two months of simple imprisonment and pay the sum of ₹6.65 lakh regarding the dishonoured cheque issue.
