The father of Atul Subhash, an engineer who committed suicide in Bangalore, has refused to immerse his ashes. He says that he will not immerse the ashes until his son gets justice. Atul Subhash himself had written this in his suicide note. He had said that if he does not get justice, then his ashes should be thrown in the drain outside the court. However, Karnataka Police has arrested Atul’s wife Nikita and other members of her family. In such a situation, Supreme Court lawyer Kanika Bhardwaj told under which sections Nikita can be punished and how much punishment she can get.
Kanika Bhardwaj told that after marriage, men have almost no rights regarding domestic violence. They only have the right to divorce, but in case of domestic violence, they cannot file any case against the girl.
Misuse of the law
Kanika Bhardwaj said that when the Indian law changed and the Indian Judicial Code replaced the IPC, the Supreme Court had asked the Central Government to change Section 498A because it was being misused. However, the Center did not pay attention to it and women are still misusing the law. She said that under 498A, if a man or his close people harass a girl in any way, then they can be punished. There is a provision of punishment up to seven years in this.

The lawyer said that the police officers deliberately applied the wrong sections. They also applied sections of unnatural sex, murder and sexual exploitation, even though there was no proof of these. Atul Subhash could not get the right help due to lack of information. The Supreme Court has a facility to get information for free, but people are not aware of it. Society is also responsible for Atul Subhash’s death, because in such cases people make a preconceived notion and do not help the person who is under pressure. Even from the legal point of view, Atul Subhash had no option other than divorce. In such a situation, the lack of proper law is also responsible for this.
Nikita may get 7 years jail
Kanika Bhardwaj told that if it is proved that Atul Subhash was forced to commit suicide, then his wife Nikita and other people responsible can be sentenced to up to seven years. However, this will take a long time. After the police investigation, the charge sheet will be filed and after that the court will give its verdict. It will be difficult to prove in the court that Nikita forced Atul to commit suicide, but if it is proved, then Nikita can be jailed as well as fined.
