The Supreme Court of the United States has decided against issuing an emergency stay on the extradition of former Pakistan military doctor, Tahawhur Rana, to India. Flora, who is alleged to have played a significant role in the 2008 Mumbai terror attacks, attempted to stop his extradition to India on the grounds that he would be tortured, “as a Muslim of Pakistan heritage.”
Extradition Order Challenged
Rana maintained that the order of extradition to India breached American law together with the United Nations Convention Against Torture “due to there being reasonable beliefs that if he is extradited to India, the petitioner is likely to be tortured.”
In addition, these “severe medical conditions” available in conjunction with his “suffered” aspect makes his extradition to Indian detainee centers a "de facto" death sentence in this scenario.
One plea rejected, renewed plea filed
Supreme Court Judge Elena Kagan dismissed his appeal on Wednesday, who currently resides in the Metropolitan Detention Center in Los Angeles. Afterwards, he filed renewed application with Chief Justice Roberts to stop his extradition to India.
Trump revealed the extradition of Rana.
It is worth noting that the U.S. Supreme Court has already approved the extradition of Rana, and last month, President Donald Trump had also claimed that the plotter of 26/11 will be sent to India.
Rana's association with the 26/11 Terror Attack.
Rana, a Pak Army ex-doctor of Canadian nationality, was a significant player in the planning of the attack of terror on the city of Mumbai in 2008 which was executed by ISI and LeT.
Rana, who used to run an immigration consulting firm with American and Canadian edges, used it to facilitate Headley aka Daood Sayed Gilani, the main conspirator of the attack, to travel to Mumbai and do a ring of the locations which were later assaulted by LeT terrorists.
Funded in absentia of some other terror issues in the United States.
Rana was not convicted in 26/11 in US but he was sentenced in 2013 to 14 years of imprisonment for conspiring to give material support to a terrorist scheme in Denmark and for aiding the LeT’s terror plans.
