An official decree on a national emergency of the southern border was signed by President Donald Trump on January 20 2025. He references the Insurrection Act in his order, citing a review period of 90 days for the executive order’s potential applicability as justifiable in this context. This decision period will end on the 20th of April.

Based on the clause of the order, both the Secretary for Defence and Secretary for the Department of Homeland Security are required to check the state of the border individually, synthesize their assessment, and report it to the President. This document will dictate whether some action including passing the Insurrection Act will have to be taken to gain Commanding Control.

The Act of Insurrection: Understanding the Prerogative

A sitting President can send the US army and National Guard, stationed in domestic territories, into active duty under certain conditions. These include, but are not limited to active riots, violence, or organized defiance of the government. It is this law that permits bypassing the Posse Comitatus Act, which would otherwise ban forced militaristic policing of civilians during peacetime.

The more relevant detail, as stated, is the unilateral excise of authority to decide the timeline and conditions under which those powers may be enacted.

Comparison of the Insurrection Act with Martial Law

The Insurrection act does not place martial law, although many people think it does. Unlike martial law, which puts civilian government in the hands of military commanders known as generals, the Insurrection Act permits the military to aid civilian bodies without superseding them. Such deployments do not suspend presidential powers.  

Legal ambiguities and the possible abuse of the Act remain a concern.  

Experts have expressed concern with the lack of definitional clarity, particularly as it pertains to the Act’s “outdated” and “insurrection” and “rebellion” references. The Brenner Center for Justice and other such institutions raise concern over the risks of legal overreach stemming from undefined policies, in essence warning that any sitting president would have the ability to quell opposition.  

Tension Builds Ahead of April 20 Decision  

Speculation is rife regarding whether Trump will decide to invoke the Insurrection Act with the deadline count-down set for April 20. The placement of U.S. troops at the southern border coupled with discussions of relocating as much as 30,000 migrants to Guantemo Bay has added to the speculation.  

Currently, the public along with lawmakers are in a state of suspense considering the absence of a final report from the Departments of Defense and Homeland Security.
