Swiggy charged Rs 103 for delivery, court imposed 344 times fine on it

Online food ordering app Swiggy had to pay a heavy price for being arbitrary with the customers. A court imposed a heavy fine on Swiggy for this arbitrariness of the company. Swiggy had charged a delivery charge of Rs 103 for delivering food to a customer named Suresh Babu, after which while hearing the complaint, the court imposed a fine of Rs 35,453, i.e. about 344 times the delivery charge of Rs 103, on Swiggy.

Suresh Babu ordered food from Swiggy last year.

Suresh Babu had ordered food from Swiggy on November 1, 2023. The distance between Suresh’s location and the restaurant was 9.7 km, which Swiggy increased to 14 km. Due to the increase in distance, Suresh had to pay a delivery charge of Rs 103 despite having a Swiggy membership. Suresh filed a complaint with the commission saying that under the Swiggy One membership, the company had promised free delivery within a range of up to 10 km.

Now Swiggy will pay a total of Rs 35,453 to Suresh Babu.

The court reviewed the Google Maps screenshots and other evidence provided by Babu and found that the distance had been exaggerated. The court found Swiggy guilty of unfair trade practice and ordered the company to pay Suresh Babu a total of Rs 35,453 including a refund of Rs 350.48 for the meal along with 9 percent interest, Rs 103 for delivery, Rs 5,000 for mental agony and inconvenience, Rs 5,000 for litigation costs. 

45 days were given to comply with the order

Not only this, the court has also ordered Swiggy to deposit Rs 25,000 as punitive damages in the Consumer Welfare Fund of Ranga Reddy District Commission. The court has given Swiggy 45 days to comply with the order.
