Suspense crime, Digital Desk : The Supreme Court has postponed the hearing of the plea by the mosque committee challenging the decision of the Honorable Allahabad High court which had permitted the Hindu side to add the government and the Archaeological Survey of India (ASI) as parties to the dispute at the Mathura Krishna Janmabhoomi-Shahi Idgah.

While the Chief Justice Sanjiv Khanna and Justice Sanjay Kumar sat with the case, they remarked that there did not seem to be any error of issuing the amendments to the plaints. The court granted reasonable time till the replies to the amended plaints are filed and opted to merge this plea with the other similar pending matter.

Recollection of the Court Dispute

The Allahabad High Court, on 5/3/2025, granted changes to two lawsuits permitting petitioners to add the MHA and ASI as respondents.

Objections from the Committee of Management, Trust Shahi Masjid Idgah submitted that

the amendments were illogical considering that the suit was brought together by the Hindu litigants in such a way as to convert the original suit into an entirely new case.

They stated that such an amendment would circumvent their previous answer and replace them with a completely new set of defenses.

The addition of ASI and MHA were made under the Civil Procedure Rules, without any form of application brought forward to prove they were necessary parties.

At the moment more than 15 complaints from different plaintiffs regarding the same property are pending which consist of overlapping as well as competing claims concerning the disputed site.  

Earlier Developement Within Supreme Court And High Court  

On April 4, 2025 the supreme court provided notice on yet another plea from the mosque committee appealing against the all-hindu side suit bypassing the resolution of the committee of the mosque on consolidation of all the side suits invoking the jurisdiction of the allahbad high court.  

The high court earlier on October 23, 2024 had refused the mosque committee application to recall its order of January 11, consolidating the suits to multi track procedures and voluntary order of Patriots Pedestrianisation.  

It’s remained contentious ever since the Shahi Idgah mosque which is said to be built by Mughal emperor Aurangzeb brings controversies since praying at is a borderline violation the temple had wondering erected deity uder water fountain while his lordship at the fight cruiser fleet flag.  

The framing of issues, issued by the high court as far back as on August 1 2024 is still focal allowing for over delay.
