Shimla court gives a big blow to Muslim side in Sanjauli Masjid case, 3 floors will be demolished

Shimla:  The petition of All Himachal Muslim Welfare Organization in the Sanjauli Mosque case has been rejected by the Shimla District Court. The court has upheld the decision of the Municipal Commissioner’s court. According to this, the work of removing the illegal part from Sanjauli Mosque will continue. The Muslim Welfare Organization had challenged the decision of the Municipal Commissioner’s court in the district court.

The court of the Municipal Corporation Commissioner had given this order.

Earlier, on the basis of the affidavit of the Sanjauli Mosque Committee, the court of Municipal Corporation Commissioner had ordered to demolition of the three floors above the mosque within two months. Muslim Welfare Organization had approached the District Court against this decision. The case regarding Sanjauli Mosque is pending in the court of Municipal Corporation Commissioner and the next hearing is scheduled on 6th December. 

Muslim side can challenge the order in the High Court.

Vishwa Bhushan, the lawyer of the petitioner All Himachal Muslim Welfare Organization, said that the court has rejected his petition. On the question of challenging this matter in the High Court, Vishwa Bhushan said that he would decide on it after reading the order. Vishwa Bhushan said that he had challenged in the court the eligibility of Sanjauli Masjid Committee and the committee’s president Mohammad Latif to give an affidavit in the court.

The president of the Sanjauli Mosque Committee gave this information.

Mohammad Latif, president of the Sanjauli Mosque Committee, said that the court has rejected the petition of the Muslim Welfare Organization. Now the decision of the Municipal Corporation Commissioner regarding Sanjauli Mosque will remain intact. Latif said that the work of removing the roof and a temple above the mosque has been completed. Also, due to the unavailability of laborers, the work of removing the illegal part of the mosque will not be completed till March. 

At the same time, Jagatpal, the lawyer of the local residents, has welcomed the decision of the district court. He said that the High Court has ordered that the matter be settled as soon as possible. In such a situation, he has expressed hope that the Municipal Corporation will take a final decision on the matter.
