The crucial ruling was handed down by a division bench comprising Justice Indrajit Singh and Justice Sandeep Taneja while dismissing a petition filed by Neeraj Bishnoi, a former senior auditor with North Western Railway. Bishnoi had resigned from his government position on October 10, 2023, specifically to contest the Rajasthan Assembly elections. His resignation was officially accepted by the railway department on November 1, 2023, following which he ran for the Ratangarh Assembly seat in Churu on a Bahujan Samaj Party ticket, ultimately losing the contest.
Following his defeat, Bishnoi submitted an application on January 1, 2024, seeking to withdraw his resignation and regain his government post. When the department rejected his reinstatement request on January 29, 2024, he challenged the administrative refusal before the Central Administrative Tribunal (CAT) in Jaipur and subsequently escalated the matter to the High Court.
