Suspense crime, Digital Desk : The actor Saif Ali Khan stabbing case is one where Shariful Mohammad Islam has been accused and he has also alleged that his arrest by law enforcement authorities was illegal through a written application to a Mumbai based court. While he filed an application to a lower court in Mumbai, he stated that police officials violated standard arrest protocol by failing to inform him of the legal basis for his arrest, claiming his constitutional rights were violated in accordance with Indian law.

Defendant Withdraws Bail Application, Challenges Process of Arrest

Islam is a 30 year old Bangladeshi National currently incarcerated in Arthur Road Jail. He withdrew a bail application during a hearing at the Mumbai session court and later placed a fresh application before the judicial magistrate of the first class at Bandra claiming his arrest was unlawful and therefore sought a release on the grounds that he needed not to be detained.  

Plea Cites Violation of Section 47 BNSS

Through a lawyer, the case has been framed in the regard that the arrest by law enforcement authorities violates section 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) which Islam’s appeal claims lack the documentation to prove bail proceedings were conducted in compliance with the regulation which states that a written notice of arrest must contain the grounds for arrest alongside cited charges, including the right to bail.  

Police Response Required By The Court

Islam claims police did not abide by basic procedural jurisprudence surrounding documentation detailing the arrest. The court has directed the police to respond and sit for 13th May.

Case Background

On January 16, Saif Ali Khan suffered an assault in his 12th floor apartment in Bandra, Mumbai. A 54-year-old actor was repeatedly stabbed by an intruder which required him to undergo emergency surgery. He was in hospital for five days.
