In a major administrative crackdown on highway concessionaires, the Hapur district administration has initiated strict revenue recovery proceedings against M/s IRB Hapur-Moradabad Toll Way Private Limited. Following the toll company’s persistent failure to remit a statutory penalty and stamp duty shortfall totaling ₹38,14,26,920 within the stipulated 30-day notice window, the local revenue authorities have formally issued a Recovery Certificate (RC). The defaulted liability—stemming from an operational concession agreement executed for toll collection at the Allabakshpur-Brajghat toll plaza on National Highway-9 (NH-9)—will now be compulsorily recovered under coercive land revenue recovery laws, accompanied by compounding interest charges.

The enforcement action traces back to a comprehensive tollway concession agreement finalized on May 29, 2018, between the National Highways Authority of India (NHAI) and M/s IRB Hapur-Moradabad Toll Way Private Limited for vehicular toll collection rights across the Garhmukteshwar corridor:
Shortfall Assessment: A statutory scrutiny conducted by the Assistant Commissioner of Stamps revealed that the concessionaire had substantially undervalued the contract, resulting in a direct stamp duty deficit of ₹37,77,26,920.
Additional Penalty: Alongside the principal deficiency, the regulatory authority levied an administrative fine of ₹37,00,000, bringing the total statutory demand to ₹38,14,26,920.
Ignored Deadlines: Despite receiving a statutory 30-day compliance window to deposit the outstanding dues directly into the state treasury, the concessionaire failed to make the payment, prompting the revenue department to escalate the matter through coercive certification.

Land Revenue Recovery Process: Under the provisions of the Uttar Pradesh Revenue Code, issuing an RC empowers revenue tehsildars and district collectors to attach company bank accounts, impound toll plaza collections, and seize commercial movable assets in the same manner as agricultural and land revenue arrears.
Accumulating Penal Interest: SDM Yadav highlighted that the company faces simple interest calculated at the rate of 1.5 percent per month on the principal stamp duty amount, levied continuously from the contractual cutoff date of June 29, 2018, until the actual date of realization, adding substantial crores to the firm's total financial exposure.
