In a landmark judgment that will have far-reaching implications for government employees across Uttar Pradesh, the Lucknow Bench of the Allahabad High Court has delivered a decisive verdict in favor of the Old Pension Scheme (OPS). The court dismissed a Special Appeal filed by the State Government, which challenged a previous order to grant OPS benefits to a group of Junior Engineers in the Public Works Department (PWD).
The Core of the Legal Battle
The case originated when several Junior Engineers (JEs) of the PWD approached the court seeking retirement benefits under the Old Pension Scheme. These employees argued that although their formal appointment happened later, the recruitment process had commenced well before the New Pension Scheme (NPS) was implemented on April 1, 2005. They contended that they should be governed by the rules prevalent at the time the advertisement for their posts was released.
High Court’s Reasoning: Appointment vs. Recruitment Process
The Division Bench, comprising Justice Rajan Roy and Justice Om Prakash Shukla, upheld the earlier decision of the Single Bench. The court observed that if the selection process was initiated before the cut-off date of April 1, 2005, the employees cannot be denied OPS benefits simply because the administrative process of appointment was delayed by the government.
The court emphasized that the right to a pension is a fundamental service condition, and the state cannot use procedural delays to transition employees into the less beneficial New Pension Scheme.
A Setback for the UP State Government
The Uttar Pradesh government had filed a Special Appeal arguing that the employees joined service after the NPS was already in force, and therefore, they were only entitled to the contributory pension model. By dismissing this appeal, the High Court has sent a clear message that the date of the recruitment notification holds legal weight over the actual date of joining in cases of pension eligibility.
What This Means for Other UP Employees
This ruling is expected to open the floodgates for thousands of other state employees in various departments who were recruited under similar circumstances. Employees from the Education, Police, and Irrigation departments who were caught in the "transition phase" of 2005 may now use this judgment as a legal precedent to demand a shift from NPS back to the Old Pension Scheme.
