The implementation of the Uniform Civil Code has made Uttarakhand become India's earliest state to formally adopt UCC. Chief Minister Pushkar Singh Dhami announced the UCC portal system while revealing the official implementation of this important national initiative.
Chief Minister Dhami declared that the Uniform Civil Code represents a constitutional approach to fight discrimination when he launched the program. Through this code all citizens obtain equal rights and women gain real societal empowerment. The Uniform Civil Code stands as a non-discriminatory system that operates independent of all religious and communal practices while upholding "The Uniform Civil Code is not against any religion or sect since it shows neutrality to every person or social group," according to Dhami.
What stands behind the Uniform Civil Code (UCC)?
Members of Uttarakhand society should comply with unified legal structures moved forward by the Uniform Civil Code despite religious or gender background. According to these legal frameworks people receive rules about marriage divorce live-in relationships property rights adoption and other fundamental matters.
The UCC's primary mission includes getting rid of halala along with polygamy child marriage and triple talaq to ensure balanced laws throughout communities according to Dhami at the launch event. The rights of Scheduled Tribes protected by Article 342 of the Constitution remain untouched by the Uniform Civil Code.
The Essential Provisions of the Uniform Civil Code
Marriage Laws
Under the UCC's rules individuals must wait until they reach 21 for males and 18 for females to marry while completing their education.
All individuals are required to register their marriages per new regulations.
UCC outlaws multiple marriages and young marriages and triple divorces therefore establishing fair family law provisions throughout India.
Inheritance and Property Rights
Through the UCC judicial system children of any gender will obtain equal inheritance benefits because the code strips away distinctions based on gender. The UCC establishes "child" as an inclusive legal term which helps create gender equality throughout the legal framework.
Children from living together couples get legal backing through this law which gives them full access to their property rights who share them as legit heirs.
Provisions for Live-in Relationships
All couples dwelling together must file a relationship registration form if both partners are over 21 years old. People younger than 21 must receive their parents' permission to complete registration.
The legislation of the UCC extends its application coverage to live-in couples regardless of their location as long as one partner lives in Uttarakhand.
Breaking registry requirements or submitting wrong information during registration can result in up to three months imprisonment in addition to a ₹25,000 fine or both punishments.
Management of more than thirty days without completing registration can result in monetary fines that reach ₹10,000 and a penalty of three months in prison.
