Lyricist Javed Akhtar’s review petition against summons
Mumbai: Bollywood lyricist Javed Akhtar has filed a review petition in the Sessions Court against the summons issued by the Mulund Magistrate Court on December 13, 2022.
The court issued the summons following a criminal defamation complaint against Akhtar over his comments about the RSS.
Advocate Santosh Dubey complained after Akhtar expressed his views on Taliban rule in Afghanistan in a TV interview on 3 September 2021. It has been said in the complaint that Akhtar’s statement has hurt the sentiments of people associated with the RSS.
Dubey said that he was a strong supporter of the RSS and that Akhtar’s statements had an impact on the society, after which many disassociated themselves from the organization after Akhtar compared the RSS to the Taliban.
After hearing Dubey’s arguments, the court ordered initiation of proceedings against the accused under the offense of defamation. In the review petition filed by Akhtar, the magistrate court has sought a stay on the proceedings saying the lawyer has no right to complain and is only trying to gain fame and money.
The summons issued by the magistrate is not sustainable as the singer resides outside the jurisdiction of the court. Akhtar argued that the magistrate had failed to follow due process under the section of the Criminal Code, which requires investigation of the case before issuing summons or initiating proceedings against the accused.
