The US Citizenship and Immigration Services (USCIS) has officially approved steep fee revisions across major categories under the popular EB-5 Immigrant Investor Program. Scheduled to take effect from November 30, 2026, these fee revisions will significantly push up the total financial outlay for Indian applicants already navigating long processing waiting periods and visa backlogs.

EB-5 Filing Fees More Than Double for Individual and Regional Center Investors

Under the newly released regulatory schedule, the filing expenses for key investor petitions are set to undergo drastic increases across both direct and regional center routes:

Form I-526 (Stand-Alone Investor Petition): The mandatory application fee filed by individual investors will climb from the current $3,675 to $7,615, representing an increase of over 100 percent.

Form I-526E (Regional Center Investors): Investors pursuing residency via designated regional centers will see filing charges jump from $3,675 to $7,850. In addition, both initial petition forms will incur an added technology fee of $75.

Form I-829 (Removal of Conditions): The petition required to transition from a conditional Green Card to unconditional permanent residency will increase from $3,750 to $5,000.

Massive Surge in Regional Center Designation Fees: Commercial entities and regional centers will face steep operational overheads, with Form I-956 (regional center designation application) rising from $17,795 to $44,115, while Form I-956F charges will surge up to $42,675.

USCIS explained that the agency relies almost entirely on user fee collections to fund core operations, including background verifications, eligibility screenings, comprehensive fraud investigations, and standard petition adjudication workloads.

Understanding the EB-5 Investor Visa Pathway

The EB-5 Immigrant Investor Program provides an expedited legal pathway to US permanent residency for international investors and their immediate family members:

Qualifying Investment Thresholds: Foreign nationals must invest a minimum baseline of $800,000 in Targeted Employment Areas (rural pockets or areas with high unemployment) or designated infrastructure initiatives, or $1.05 million for standard commercial projects.

Economic and Employment Milestones: The investment project must directly create or preserve at least 10 full-time jobs for qualified American workers within a two-year timeframe.

Family Coverage: The principal investor's spouse and unmarried dependent children under the age of 21 are eligible for permanent residency under the same petition.
