RBI Rules : Claim Up to ₹5,000 Per Day for Delayed Loan Documents and Credit Card Issues

Post

Dealing with bank-related processes often involves running from pillar to post, especially when routine requests get stuck in administrative delays. Whether it is a credit card that refuses to close or original property documents withheld long after a loan has been fully repaid, customers frequently bear the brunt of institutional tardiness. However, under regulatory guidelines established by the Reserve Bank of India (RBI), customers are empowered not just to raise formal grievances, but also to claim daily financial compensation when banks fail to meet strict turnaround times.

1. ₹500 Per Day for Delayed Credit Card Closures

When a customer formally requests the closure of a credit card and clears all outstanding dues, banks are bound by strict operational timelines:

The Deadline: Financial institutions must officially close the credit card account within seven working days of receiving the request.

The Penalty: If the bank fails to process the closure within this stipulated window, it may be required to pay a penalty of ₹500 for each calendar day of delay until the account is formally closed.

2. ₹5,000 Per Day for Withholding Original Property Documents

Clearing a home loan or personal loan is a major milestone, but retrieving original collateral documents can sometimes turn into a frustrating ordeal:

The Timeline: Banks must return all original property and collateral documents within 30 days of full loan repayment.

The Penalty: For any unjustified delay attributable to the bank beyond this 30-day period, the customer is entitled to compensation of ₹5,000 per calendar day. Furthermore, in the event of lost or damaged documents, the bank is legally obligated to assist in securing certified duplicate copies while bearing all associated expenses.

3. ₹100 Per Day for Credit Report Correction Delays

Maintaining an accurate credit score is crucial for financial health. If a customer files a dispute or complaint regarding incorrect information listed on their credit report:

The Timeline: Credit institutions and bureaus must investigate and rectify valid errors within 30 days.

The Penalty: Failure to resolve the correction within the stipulated timeframe can attract compensation of ₹100 per calendar day of delay.

4. Compensation for Failed Digital Transactions

With the massive surge in digital payments, transaction failures can temporarily lock up customer funds:

Refund Mandates: If money is debited from your account due to a failed UPI, ATM, or card transaction, RBI guidelines require banks to reverse the amount within a strictly defined window.

Delayed Reversals: In specific categories of delayed reversals, automated or complaint-based compensation of up to ₹100 per day applies, depending on the transaction type and prevailing operational guidelines.

5. Liability for Bank Locker Losses

Safety deposit lockers are trusted for valuables, but banks cannot entirely deflect responsibility during untoward incidents:

Liability Cap: Under RBI safety guidelines, if goods stored in a bank locker are damaged or stolen due to the bank's proven negligence or security failure, the bank's liability is fixed at 100 times the annual locker rent.

How to Claim Your Compensation

To successfully claim compensation for bank delays, customers must maintain a meticulous paper trail:

Preserve all formal complaint copies, acknowledgment receipts, email timestamps, and interaction logs.

If a branch or institution fails to resolve the grievance within the timeline, escalate the matter through the bank's internal Principal Chief Risk Officer (PCRO) or grievance redressal officer.

If unresolved, lodge a formal complaint on the RBI's dedicated grievance portal (CMS portal). Note that compensation applicability depends strictly on relevant regulatory frameworks, established timeframes, and specific case circumstances.
