The Madhya Pradesh High Court has reserved its order on a petition seeking to stop the release of the upcoming film "Haq," reportedly inspired by the landmark Shah Bano case. Siddiqua Begum Khan, the daughter of the late Shah Bano Begum, filed the plea, arguing that the movie misrepresents her mother's life and was produced without the family's consent, violating their privacy. The film, starring Yami Gautam and Emraan Hashmi, is scheduled for release on November 7, 2025.
The petition, filed in the Indore bench of the High Court, claims the filmmakers are turning a personal struggle into a commercial product and distorting factsThe family's lawyer stated that they were never contacted for permission to use Shah Bano's name or personal story, which is mandatory under the right to privacy. They allege that the teaser and trailer contain derogatory content and inaccuracies about Shah Bano's life.
In response, the filmmakers have argued that the movie is a "dramatized and fictionalized" adaptation inspired by the 1985 Supreme Court judgment and a book.[4] Their legal counsel pointed to a disclaimer clarifying that the film does not claim to be a biopic or documentary and is not a factual representation of any person's life.
The Shah Bano case of 1985 was a pivotal moment in India's legal history. Shah Bano, a Muslim mother of five from Indore, was divorced by her husband in 1978 and subsequently filed a plea for maintenance. The Supreme Court ruled in her favor, affirming that Muslim women are entitled to maintenance under secular law, sparking a nationwide debate on minority rights and the Uniform Civil Code.The verdict was later effectively nullified by the then-government through new legislation.[2]
After hearing arguments from all parties, including the producers and the Censor Board, the court has reserved its judgment on whether to stay the film's release.
