Prayagraj, May 22 (Hindustan). The Allahabad High Court has granted conditional bail to Deoria treasury clerk Dinesh Upadhyay, who was caught red-handed accepting a bribe of Rs 10,000. He has been directed to be released on personal bond and two sureties. The accused has been in jail since March 23.
Citing the Supreme Court decision, the court said that mere possession of money does not constitute a conviction. In any case, the petitioner deposited the money in the complainant’s account on March 27, a day before the trap was set. Justice Rajeev Mishra has given this order accepting the bail plea of Dinesh Upadhyay.
Sonu Kumar alias Surya Prakash Mani is known to have lodged a complaint with the Vigilance. On the basis of which the inspector in-charge trap team caught the applicant red-handed. Ten thousand rupees were recovered from him. Chemical tests also confirmed the allegation. On the same day an FIR was lodged at Kotwali, Deoria and the petitioner was arrested and sent to jail. The petitioner’s advocate said that there was no other case against him. He is innocent. He has been trapped. Receipt of money does not prove bribery. There is no evidence against him of soliciting and accepting bribes. He transferred the money a day ago. So there is no question of bribery.
