Attempt to murder and FIR registered under SC-ST Act quashed

Prayagraj, May 15 (Hindustan). The Allahabad High Court has quashed the FIR and attempted murder registered at Karachhana Police Station in Prayagraj under the SC-ST Act. The court has asked the petitioner in the case to appear before a magistrate for hearing under sections of assault.

Justice Faiz Alam Khan passed the order partially accepting the petition of Rajveer Kumar Pandey alias Babbu Pandey and three others. An FIR under Section 307, 323, 504, 506 of the IPC and Section 3(1)(10) of the SC-ST Act was registered against the petitioners under Section 156(3) at Karachha Police Station.

After the chargesheet was filed, the magistrate court issued the summons. The petitioners challenged it in the High Court and sought quashing of the entire criminal proceedings, calling the charges false. It was submitted on behalf of the petitioners that the case has been registered u/s 156(3). Which is completely false and fake.

The statements made by the complainant u/s 202 were false and were admitted by himself. The witness has confirmed this by giving an affidavit. Accepting the petitioner’s contentions, the court allowed the petition in part and struck down Section 307 of the IPC, sections of the SC-ST Act and directed the lower court to hear the proceedings under Sections 323, 504 and 506 of the IPC.
