Jaipur, May 13 (Hindustan Times). The Rajasthan High Court has quashed the entire process of acquisition of 27 hectares of land for Metro Car Depot at Sitapura for the purpose of Jaipur Metro. The court has quashed the notification issued on May 26, 2011, the notification dated July 5, 2012 and the notice issued on July 11 under Section 4, considering them against the rules. The court said in its order that the necessary provisions of Section 5A have not been followed during the acquisition process. In such a situation, the state government and metro administration should not interfere regarding the related land. Justice Umashankar Vyas gave this order on the petition of Alok Kotawala and others. The court said that about 16 objections were presented before the land acquisition officer, including huge plantation on the land, non-preparation of DPR, motels being built on the land and pending 90B action of some land, but he did not even consider 13 objections. Did.

It was said in the petition that the notification issued under section 4 regarding the land is against the law. At the same time, the petitioner was not even given a chance of personal hearing. Apart from this, the objections presented under Section 5A were not settled by the Land Acquisition Officer. At the same time, the ground is six meters below the surface and is impractical to build a metro car depot. On the other hand, it was said on behalf of the State Government and Metro that the petitioner was given sufficient opportunity of being heard, but he remained absent on his own at the time of hearing. The LAO sent its recommendation to the State Government only after considering the objections. Therefore, the action of non-receipt is justified. As such, the petition should be dismissed.
