The court said in its order that the necessary provisions of Section 5A have not been followed during the acquisition process. Justice Umashankar Vyas gave this order on the petition of Alok Kotawala and others. The court said that about 16 objections were presented before the land acquisition officer, including huge plantation on the land, non-preparation of DPR, motels being built on the land and pending 90B action of some land, but he did not even consider 13 objections. It was said in the petition that the notification issued under section 4 regarding the land is against the law. At the same time, the petitioner was not even given a chance of personal hearing. Apart from this, the objections presented under Section 5A were not settled by the Land Acquisition Officer. On the other hand, it was said on behalf of the State Government and Metro that the petitioner was given sufficient opportunity of being heard, but he remained absent on his own at the time of hearing.
