In a press release on Tuesday, before Trump took power, the Department of Homeland Security announced this final rule which will help American companies increase their ability to hire skilled workers.

This decision of Joe Biden will make it easier for more and more Indians to get jobs and stay in America. The release said, “The new rule allows employers to retain talented workers by streamlining the approval process. It modernizes the H1-B program by improving its integrity and monitoring.” This rule is based on Biden’s previous efforts. The administration will ensure that the labor needs of American businesses are met. At the same time, the undue burden on employers can be reduced while following the rules of US employee protection.

Applications will start from 17 January 2025

Applications for visas in this program will begin on January 17, 2025. Its applications will require a new version of Form I-129, Petition for a Nonimmigrant Worker, which is the effective date of the rule. At the same time, no grace period has been given to accept the previous form versions. In such a situation, USCIS will soon publish a preview version of the new Form I-129 version on USCIS.gov.

What is the purpose of the new rule

The new rule aims to provide greater flexibility to employers and workers by modernizing the definition and criteria for specialty occupational positions as well as non-profit and government research organisations that are exempt from the annual statutory cap on H-1B visas. “The rule extends certain flexibilities to students on F-1 visas who wish to change their status to H-1B to avoid disruptions in lawful status and employment authorisation for those F-1 students,” the release said. “The final rule will allow USCIS to more quickly process applications for most individuals who were previously approved for H-1B visas.” In addition, the rule will also allow H-1B beneficiaries with a controlling interest in the petitioning organisation to be eligible for H-1B status, subject to appropriate conditions.
