Whether it is property division or transfer to family members, now settlement will be done easily in Rs. 5000, Yogi government is going to provide this big facility to the public

In states like UP and Bihar, disputes usually happen over old property. Due to this, people keep visiting courts for years. Many murders take place, this issue has a huge contribution to the increase in crime. But now the UP government is working on getting its people rid of this problem. The government is creating an environment of ease of living for the common man. In which a new system for property division and management is going to be implemented soon. In this system, the property of generations can be divided easily without any dispute. Apart from this, a person will also be able to transfer his immovable property to his family members while he is alive. 

Stamp duty will be 5000

After providing a big facility to transfer your immovable property to blood relatives with a stamp duty of only Rs. 5,000, now a big facility is going to be provided in family division and settlement in Uttar Pradesh. Chief Minister Yogi Adityanath has directed that the stamp duty payable for the division of immovable property among the members of a family and for transferring the property to the family members by a living person should also be fixed at Rs. 5,000. The Chief Minister said that due to high expenses, disputes often arise in the event of division in the family and court cases also take place. With minimum stamp duty, the settlement will be easy among the family members. 

There will be simplification in the property division

In an important meeting on Tuesday, the Chief Minister said that under the guidance of the Prime Minister, the state government has made several efforts for the ease of living of the common man. Simplification in the property division and settlement process will provide more convenience to the people.

  • In the partition deed, all the parties are joint shareholders in the divided property and the partition takes place among them.
  • The proposed exemption in the partition deed will cover all lineal descendants of the same deceased person who are co-owners i.e. if the present surviving sharer in the original property of grandfather is uncle/nephew/niece, then he/she can avail it.

  • In a settlement deed, the settling party (surviving) disposes of his extensive property among several parties.
  • Under the exemption proposed in the settlement deed, the settling party can settle in favour of all his lineal descendants, of any generation. That is, if the great-grandfather or great-grandmother is alive, then the property can be settled in their favour, and if the great-grandson or great-granddaughter is alive, then it can be settled in their favour as well.
