Power of attorney registration is not prohibited in the state

Prayagraj, May 22 (Hindustan). The Allahabad High Court has refused to interfere with a petition seeking a stay on the registration of general power of attorney in Ghaziabad and Gautam Budh Nagar. The court has said that the Supreme Court has legalized the sale of property through power of attorney. Therefore it cannot be banned.

The court directed the SIT, which is probing the stamp duty loss case to the government by selling large number of properties outside the state through fake transactions through power of attorney in Ghaziabad, to submit an inquiry report within four months.

A division bench of Justice Ashwani Kumar Mishra and Justice Vinod Diwakar passed the order while dismissing the petitions filed by Tehsil Bar Association Gandhi Nagar Ghaziabad and Society for Voice of Human Rights and Justice.

The court said that the petition was not filed in public interest. No victim has appeared in court. IG Registration UPA filed an affidavit and informed that a total of 92,520 powers of attorney have been registered in the state. Out of which 53,013 Powers of Attorney are from Ghaziabad and 10374 Powers of Attorney are from Gautam Buddha Nagar. 29,425 power of attorneys of Tehsil Sadar Ghaziabad have sold properties in other states outside the state. Due to which the state has suffered financial losses and disputes have arisen in the state.

The court said that the government itself has said that there is no bar on registering the power of attorney. SIT is investigating to check bogus transactions. The court has rejected the petitions.
