Bollywood actress Juhi Chawla on Thursday withdrew her petition from the Delhi High Court seeking dismissal of her suit against 5G wireless network technology. Which demanded that their lawsuit against the 5G rollout be declared “rejected” instead of “dismissed”.
Justice Jayant Nath allowed the withdrawal of the petition after the statement of Chawla’s lawyer Deepak Khosla. The court said- Chawla’s counsel wants to withdraw the application with liberty to avail the remedy before the appellate court. The application is rejected on the grounds of withdrawal.
This was the rationale for the withdrawal of the petition
Juhi’s counsel argued that the suit, which never reaches the stage of litigation, can only be rejected or returned in terms of the Code of Civil Procedure but cannot be dismissed. The court had given a week to deposit a fine of Rs 20 lakh on Juhi. Chawla also withdrew the application for a refund of the court fee.
This was the whole matter
In June, a bench of Justice J R Midha had termed the suit filed by Chawla and two other petitioners against the 5G rollout as flawed, abuse of process of law and for publicity. and was dismissed with a fine of Rs 20 lakh.
