Jallikattu in Tamil Nadu: The Supreme Court has upheld the annual sport of Jallikattu in Tamil Nadu and refused to ban it. The Supreme Court upheld the state government’s law allowing Jallikattu in Tamil Nadu. He called for the law to be repealed, citing cruelty to the bulls participating in it. The Tamil Nadu law is said to be in violation of the Prevention of Cruelty to Animals Act passed by Parliament.
The Supreme Court said- the aspect of cruelty has been taken care of in the new law. Sports have been a part of Tamil Nadu’s culture for centuries. It cannot be interrupted. Action should be taken against animal cruelty.
It may be noted that on December 8 last year, the court in Animal Welfare Board of India Vs. Union of India & Ors. Judgment was reserved in WP(C) No. 23/2016 and connected matters.
Animal Welfare Board of India Vs. The petitions filed in the names of Nagaraj and others have sought quashing of the notification issued by the Government of India on January 7, 2016.
According to information, the matter was pending, but in the meantime the Prevention of Cruelty to Animals (Amendment) Act, 2017 was passed in Tamil Nadu. Later a writ petition was filed seeking to strike down the Act.
The Supreme Court then referred the matter to a Constitution Bench to determine whether Tamil Nadu could protect Jallikattu as its cultural right under Article 29(1) of the Constitution, which guarantees the protection of cultural rights of citizens.
A bench of then Chief Justice Dipak Misra and Justice Rohinton Nariman observed that the writ petitions revolving around Jallikattu involved important questions regarding the interpretation of the Constitution. It was then recommended that the matter be referred to a Constitution Bench to determine the answers to five questions apart from those raised in the writ petition.
Justice Ajay Rastogi said can we draw any conclusions based on these reports/pictures? Sporadic incidents may happen, but we are investigating the law against the Constitution. Any opinion based on pictures would be a risky position. We cannot record a search based on that.
Justice Hrishikesh Roy said- What is the meaning of blood sport. Why is it called blood sport? No one uses weapons. What is your understanding of the concept of blood sports? People here are open minded. Cruelty can happen. Don’t show us the definitions. Tell us how this game has death, it doesn’t mean it’s a blood game. I haven’t received my answer yet. People there do not kill animals. Blood can be an accidental item.
Justice KM Joseph said, mountain climbing is also dangerous, so should we stop it? If we follow these rules, what would you like that would improve the situation? Can you call us animals in the jurisprudential sense?” You state the position on vested rights.
